Der Export von vielen Materialien, Komponenten und Anlagen, die für militärische oder kerntechnische Zwecke oder im Zusammenhang mit Massenvernichtungswaffen verwendbar sind, unterliegt nach internationalen Abkommen einer strikten Exportkontrolle. Zwar werden diese auch für Zivilindustrien verwendet. Ihr Export ist aber beschränkt oder gar verboten, weil sie als „Dual-use Güter“ einzustufen sind. Der chinesische Gesetzgeber hat am 28. Dezember 2019 den zweiten Entwurf eines Exportkontrollgesetzes veröffentlicht. Die Verabschiedung dürfte im Laufe dieses Jahres erfolgen.

The trade name is the main symbol that distinguishes different enterprises. According to Art. 58 and Art. 110 of the General Rules of the Civil Law of the People’s Republic of China, a legal person shall have its own name as well as the right to name. At the same time, in practice, according to the Administrative Provisions on Enterprise Name Registration, enterprise also needs to have its own name for registration. This article will focus on the legal protection of enterprise name (in-cluding its trade name and abbreviation).
